1. Agreement to Terms
By accessing and purchasing from the SilkKaze website ("the Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you ("Customer," "you," or "your") and SilkKaze ("we," "us," or "our"). If you do not agree with any part of these terms, you must not use or make purchases from our Site.
We reserve the right to update, modify, or replace any part of these Terms of Service at our sole discretion. It is your responsibility to check this page periodically for changes. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.
2. Products and Orders
SilkKaze sells skirts, jumpsuits, and pants as described on the Site. All features, specifications, and prices of products are subject to change without notice. We make every effort to display the colors and images of our products as accurately as possible, but we cannot guarantee that your device's display will be completely accurate.
We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction on a case-by-case basis. All orders are subject to product availability. We may refuse or cancel any order at our discretion, including but not limited to instances where the product is mispriced, described inaccurately, or suspected of fraudulent activity.
3. Limitation of Liability
To the fullest extent permitted by applicable law, SilkKaze, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Site.
- Any conduct or content of any third party on the Site.
- Any content obtained from the Site.
- Unauthorized access, use, or alteration of your transmissions or content.
- The purchase, use, or results of use of any goods purchased from the Site.
Our total cumulative liability to you for all claims arising from or related to the Site or these terms shall not exceed the amount you paid to SilkKaze for the specific product giving rise to the claim in the twelve (12) months preceding the claim.
4. Intellectual Property Protection
All content on the SilkKaze Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of SilkKaze or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.
The "SilkKaze" name and logo, and all related product and service names, design marks, and slogans are the trademarks or service marks of SilkKaze. You are not permitted to use any of these marks without our prior written permission. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, or in any way exploit any of the Site's content, in whole or in part.
5. Refund & Return Policy
We want you to be completely satisfied with your purchase. If you are not satisfied with an item, you may return it within 30 days of the delivery date for a refund or exchange, provided the item is in its original, unworn, unwashed condition with all tags attached. Returned items must be in their original packaging.
Process: To initiate a return, please contact our customer service team at [email protected] with your order number and reason for return. We will provide you with a Return Merchandise Authorization (RMA) number and instructions. Returns sent without an RMA number may not be accepted.
Refunds: Once your return is received and inspected, we will notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit will automatically be applied to your original method of payment within a certain number of business days. Please note that original shipping charges are non-refundable, and you are responsible for the cost of return shipping unless the return is due to our error (e.g., wrong or defective item).
Non-returnable Items: For hygiene reasons, final sale items, clearance items, and undergarments are not eligible for return unless defective.
